The Telephone Consumer Protection Act (TCPA), 47 U.S.C. Section 227, is a federal law that regulates automated telephone calls and text messages. FL Reception uses Twilio to send automated SMS messages on behalf of our business clients. This notice describes our compliance approach and client responsibilities.
Our Technology Stack for SMS
- Twilio — telecommunications infrastructure that sends and receives SMS
- Make (Integromat) — automation that triggers SMS based on call events
- Airtable — stores caller data and tracks opt-out status
All SMS is sent through Twilio's A2P (Application to Person) 10DLC registered messaging service.
Implied Consent Basis
FL Reception's SMS text-back service sends automated messages exclusively to individuals who have initiated contact by calling a business phone number. This established business relationship provides implied consent under applicable law for service-related follow-up communications.
- Triggered only by an inbound call to the client's business number
- Directly related to the purpose of the caller's contact (appointment booking and follow-up)
- Sent from a local phone number registered to the client's business area
- Limited to customer care and appointment-related content — not promotional campaigns
Mandatory Opt-Out Compliance
All automated SMS messages sent through FL Reception include opt-out instructions: Reply STOP to unsubscribe | Reply HELP for assistance. STOP requests are processed immediately by Twilio's opt-out management system.
A2P 10DLC Registration
- Brand registration identifying FL Reception as a legitimate business SMS sender
- Campaign registration with use case: Customer Care and Appointment Booking
- Association of all client Twilio numbers with the registered campaign
Vapi AI Call Disclosure
Our AI receptionist is programmed to state at the start of every call: "This call may be recorded for quality purposes." This disclosure satisfies Florida's one-party consent recording law (Section 934.03, Florida Statutes) and is intended to comply with similar requirements in other states.
Client Responsibilities Under TCPA
- Ensure overall business communications comply with TCPA and applicable state laws
- Maintain records of customers who have opted out of automated communications
- Not direct FL Reception to contact individuals who have previously opted out
- Consult a licensed attorney regarding TCPA compliance for their industry
- Notify FL Reception immediately at hello@flreception.com of any TCPA complaint
- Understand FL Reception is a technology service and does not provide legal advice
State Law Considerations
Several states have additional telemarketing and automated communication laws. Clients in states with stricter requirements (such as California's CCPA) should consult with legal counsel.
